Nitish Katara case: Court dismisses bail plea of accused

New Delhi: A Delhi court on Saturday dismissed the
bail plea of Sukhdev Pehalwan, one of the accused in Nitish
Katara murder case, who said he wants to take part in the
wedding of his nephew.
Additional Sessions Judge J R Aryan allowed the plea of
public prosecutor B S Joon that the accused, if granted bail,
may flee from the judicial custody.
The court also considered the fact that the accused had
absconded for almost four years after the murder of Katara.
Pehalwan had moved the application seeking his release
on bail saying his nephew is getting married on November 19
and the family is in need of a responsible person to supervise
all arrangements as his elder brother was not keeping well.
The prosecutor had countered the plea saying, that the
elder brother, whose son is getting married, was ill was not
sustainable as it was he who has been pursuing the case.

Opposing the bail plea, the prosecutor had said the same
accused had absconded after the commission of the offence in
2002 and the trial against him was separated from that of
Vikas and Vishal Yadav, convicted for the murder of Katara,
because of this reason.
Pehalwan, along with Vikas and Vishal, allegedly killed
Nitish on the night of February 16, 2002.
