Ahead of verdict, Shiney struggles in Court

Mumbai: Arrested for raping his maid on June 19 at his residence in suburban Oshiwara, Shiney Ahuja on Friday struggled with his health and finally collapsed during his hearing while charges were to be issued against the actor.

Seeing his depleting medical condition, Shiney’s lawyer pleaded for the actor’s immediate hospitalization. Meanwhile, the actor is still in fast track court where jail doctors will be examining him.

The 36-year-old actor was seen crying and wincing in pain following a slip disc problem when he was produced in the court here.

Ahuja, who was unable to walk, was assisted into the court room by two constables. He was later brought outside and made to sit on a bench where he lied down, quivering following which his lawyer Sameer Nagre moved an application seeking medical treatment at the earliest.

The court directed the jail authorities to provide the actor immediate medical relief and shift him to J J Hospital if necessary for further treatment.

The court was expected to pass an order today on the application filed by Ahuja's lawyer seeking copies of the forensic report but the matter has been adjourned till October 7.

Earlier, on 23rd September, a court adjourned the framing of charges against the actor till September 25 after the defence lawyer argued that the DNA report of Ahuja is negative and sought copies of the forensic reports of both the accused and victim.

Ahuja's lawyer Shrikant Shivade sought for copies of the forensic reports of the actor and the victim, on which the prosecution is relying upon in the trial against the actor.

"While the victim's DNA report is positive and some male DNA is found, Ahuja's DNA report is negative. I would need to peruse the forensic lab reports to argue my case," Shivade said.

"One of vaginal swabs of the victim is missing and the DNA report of the actor and victim can be tampered by the police," Shivade alleged.

Shiney Ahuja, who is lodged at the Arthur Road prison in central Mumbai, has approached the Bombay High Court seeking bail after the sessions court rejected his bail on September 11 after observing that there was prima facie case against him.
