Mumbai, Feb 25: The Mumbai Police filed a mammoth 11500-page chargesheet in the 26/11 Mumbai terror attacks in the Qila court here on Wednesday. It has mentioned the names of the lone surviving terrorist – Ajamal Amir Kasab and 44 others (including 9 killed attackers) involved in the terror attack that claimed over 180 lives.
Two other terrorists, Fahim Ansari and Sabahuddin, were also produced in the special court. The duo were arrested last year from Uttar Pradesh and questioned in connection with the case.
After filing the chargesheet, Special Public Prosecutor Ujjal Nikam told reporters that copies of the same will also be given to Kasab as well as Fahim Ansari and Sabahuddin.
Zaki-ur Rehman Lakhvi, the suspected mastermind of the 26/11 carnage and believed to be hiding in Pakistan, and Lashkar-e-Toiba operative Yosuf Muzzamil are mentioned in the chargesheet as wanted accused in the case.
Nikam said 35 people are wanted in the chargesheet. According to the chargesheet, the group of 10
terrorists, who carried out the attack on Mumbai on November
26, were selected out of a group of 32.
The Crime Branch, in the chargesheet filed before metropolitan magistrate M J Mirza, has said that Kasab, an alleged Lashkar-e-Taiba operative, and others were involved in the terror strikes.
“The trial in the Mumbai terror attack case will be conducted amid high security at Mumbai's Arthur Road jail. We want 26/11 terror attacks trial to be over within three to six months,” Nikam later added.
Kasab, who was not produced in the court today due to security reasons, has been booked under charges ranging from waging war against the country to murder, attempt to murder and other provisions of the Indian Penal Code and under the stringent MCOCA. He is also being charged under the Unlawful Activities Prevention Act.
The Magistrate will commit the case to the Sessions Court
on March nine after which trial will begin in a special court
set-up inside the high security Arthur road Jail, Nikkam said.
Judge M L Tahilyani will preside over the trial. Nikkam said
the trial is hoped to be concluded in three to six months.
Kasab and his associate Mohammed Ismail Khan had allegedly gunned down ATS chief Hemant Karkare, DIG Ashok Kamte and encounter specialist Ashok Kamte in an encounter near the Cama Hospital, besides killing commuters at CST station.
Kasab was caught alive by the police at Girgaon Chowpatty while his associate Khan was killed during an exchange of fire with the police.
The chargesheet also contains Kasab’s conversation with his handlers in Pakistan, his interrogation report, besides eyewitness accounts.
Kasab, along with nine others, came through the sea route into the Indian waters, and indulged in shooting at various places including Taj Mahal Hotel, Nariman House, Oberoi hotel and VT station that resulted in killing of more than 180 people besides injuries to hundred others.
According to the chargesheet, the attack by terrorists
on November 26 killed civilians from India, UK, USA, Israel
and other countries.
Government as well as private property totally valued at
approximately Rs 41.72 crore (excluding the Taj Mahal Hotel)
was damaged.
Besides, four sailors from the 'M.V. Kuber' trawler were
also mercilessly killed by the co-conspirators in pursuance of
the criminal conspiracy hatched in Pakistan.
These attacks were launched through indiscriminate and
random firing from deadly AK-47 assault rifles and by
lobbing lethal hand grenades. Not satisfied with this mindless
bloodshed, the terrorists planted IEDs (RDX based) out of
which two were placed in taxis in which the terrorists had
travelled to the targeted sites.
The ingress of the terrorists into the city of Mumbai is
conclusive proof of the meticulous preparation, planning and
training, the chargesheet said.
Some of FBI sleuths, who have cracked the Voice over
Internet Protocol (VoIP) operations used by terrorists for
talking to their masters across the borders, are likely to
depose before the court through video-conferencing.
The chargesheet named LeT as the mastermind behind the
November 26 attacks that killed 183 persons in locations like
Hotels Taj and Trident, Chhatrapati Shivaji Terminus (CST) and
Nariman House.
It also lists the weapons and other material seized from
the terrorists.
It includes 10 AK-47 rifles, 10 pistols,
handgrenades, Nokia mobile handsets, GPS system, IEDs packed
with 80 kgs of RDX and 10 satellite phones.
In the court, Faheem and Sabauddin's lawyer Ijaz Naqvi
alleged that sleuths of Federal Bureau of Investigation were
camping in the country and interrogated his clients on several
occasions.
"What right FBI has to question them without court's
permission," asked Naqvi.
